WV family awarded $848,000 in medical malpractice trial

A Raleigh County, WV jury awarded the Estate of Frederick Sean Bailey $848,000 on October 17, 2023, following an eight-day jury trial.  On May 20, 2018, Mr. Bailey presented to the emergency department at Raleigh General Hospital with complaints of fever, and shortness of breath. Vital signs demonstrated low oxygen saturation and a diagnosis of bilateral pneumonia was confirmed.  The patient was discharged home and treated on an outpatient basis even though he demonstrated signs of sepsis.

Plaintiff alleged that Aaron Cobb, PA-C, was negligent for failing to order blood work, a chest x-ray and a second set of vital signs prior to discharge. The patient died 33 hours later from sepsis, acute respiratory distress syndrome, and respiratory distress.  He was only 43 years old and left behind two children.
